Referred to below as the "Platform".
BUYER
The natural or legal person purchasing a service through the Platform. The name, surname, e-mail and contact details provided at the time of the order are taken as the basis. Referred to below as the "Buyer".
2. Subject of the Agreement
This agreement sets out the rights and obligations of the parties in relation to the sale and performance of the services ordered electronically by the Buyer through the Platform, in accordance with Law No. 6502 on Consumer Protection and the Distance Contracts Regulation.
3. Description and Essential Characteristics of the Service
The Platform is a digital platform providing a music request and voting service between venues and their guests. The services offered for sale are:
3.1 Song Request
The Buyer joins the active session of the venue they are in and requests that a song be added to the play queue. The fee is the amount set by the venue at the time of the order and shown clearly on the payment screen.
3.2 Venue Subscription
A periodically charged subscription service enabling venue operators to use the Platform's services.
3.3 Customer Premium Membership
A membership service offering additional features to customers, charged monthly or annually.
All services are digital in nature and do not involve the delivery of a physical product.
4. Price and Payment
4.1 Service fees are shown before the order on the payment screen in Turkish Lira (₺), including VAT. No charge other than the amount shown is requested from the Buyer.
4.2 Payments are made by credit or debit card through the infrastructure of the licensed payment institution iyzico. The Platform does not store the Buyer's card details; where card storage is chosen, that operation takes place within the payment institution's secure infrastructure.
4.3 Following payment confirmation, the invoice is delivered electronically to the e-mail address provided by the Buyer.
5. Performance and Delivery
5.1 The service is performed immediately in digital form. On confirmation of payment, the song request is passed to the play queue of the relevant venue; subscription and membership services become active at the moment of payment.
5.2 As there is no physical delivery, there is no shipping, delivery time or delivery cost.
5.3 For song requests, the venue operator holds approval authority. If the request is not approved by the venue, or cannot be played for technical reasons, the amount paid is refunded in accordance with Section 6.
6. Right of Withdrawal
6.1 Under article 15, first paragraph, subparagraph (ğ) of the Distance Contracts Regulation, the right of withdrawal cannot be exercised in contracts concerning services performed immediately in electronic form and intangible goods delivered instantly to the consumer.
6.2 As the song request service purchased through the Platform is performed immediately, there is no right of withdrawal for requests whose performance has been completed. By confirming the order, the Buyer acknowledges that they are aware of this.
6.3 This does not remove the Buyer's right to a refund where the service has not been performed at all or has not been performed properly. For refund conditions see *Delivery and Refund Terms*.
7. Obligations of the Buyer
- To provide accurate and current information when ordering
- To declare that the payment instrument belongs to them and that they are authorised to use it
- Not to use the Platform in a manner contrary to the law, public morals or the venue's rules
8. Obligations of the Platform
- To provide the service as defined in this agreement
- To protect payment and personal data in accordance with the applicable legislation
- To conclude refund requests within the periods and by the procedure set out in the *Delivery and Refund Terms*
9. Relationship with Venue Operators
The actual performance of the song request service takes place through the music system of the venue where the Buyer is located. Venues' choices regarding opening a session, approving requests and managing the playlist are their own responsibility. The Platform is responsible for payment collection and the technical infrastructure.
10. Dispute Resolution
For disputes arising from this agreement, the Consumer Arbitration Committees have jurisdiction within the monetary limits announced by the Ministry of Trade, and the Consumer Courts for disputes exceeding that limit.
11. Entry into Force
By approving this agreement at the payment step, the Buyer declares that they have read, understood and accepted all of its provisions. The agreement enters into force upon confirmation of the order.
